Terms of Sales

These general conditions of sale govern the contractual relationship between the site www.victorian-animals.com , represented by John Byron, and its Client (the buyer).

Accepting an order implies full and unreserved acceptance by the Customer of these general conditions of sale.

The Customer declares to be at least 18 years old and to have the legal capacity or to be the holder of a parental authorization or guardianship allowing him to carry out a transaction on the site “www.victorian-animals.com”. He acknowledges having read the GTC when placing his order and declares that he accepts them without reservation.

Preamble

  • www.victorian-animals.com is a site dedicated to the design, creation and production of digital works of Victorian influence, and in particular of digital animal portraits, known as anthropomorphic, made by the Artist David BONNAFOUS, operating under the pseudonym of John Byron, and whose place of residence is in France.

  • Author of original and tailor-made graphic creations, Artist John Byron designs, produces and guarantees the authenticity of his original works or reproduced by his services or by a duly authorized third party. The signatures of the work, the supply or affixing of a certificate of authenticity as well as a dry stamp, are proof of this.

  • The Artist wishes that the integrity and the clarity of his ideas and conceptions regarding his work be protected and that for this purpose, the wishes and opinions that he may express are taken into account.

  • The Client and the Artist anticipate that the value of the work will increase in the future. The Client and the Artist recognize that it is desirable and fair for the Artist to benefit from any added value that the work may experience.

ARTICLE 1: PRICES

Our prices are in Euros, all taxes included (VAT not applicable, article 293 bis of the CGI), excluding shipping costs (see Delivery).

The Customer acknowledges having read the prices indicated in the “Shop” section.

In the event of an order to a country other than mainland France, you are the importer of the work (s) concerned. For all works shipped outside the European Union and DOM-TOM, customs duties or other local taxes or import duties or State taxes may be payable. These rights and sums are not the responsibility of the Artist. They will be at your expense and are your sole responsibility both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.

The Artist reserves the right to modify his prices at any time, without notice. The products will be invoiced on the basis of the rates in effect at the time of order entry.

 

ARTICLE 2: ORDER

When you click on the validation button during the ordering process, you declare to accept this one as well as the entirety of these General Conditions of Sale, fully and without reserve.

We will confirm receipt of your order by sending an email.

The data recorded on www.victorian-animals.com constitute proof of all the transactions made by the Artist and his Clients. The data recorded by the payment system constitutes proof of financial transactions.

The Artist reserves the right to cancel any order placed by a Customer for whom there is a previous payment dispute.

The information communicated by the Customer when ordering is binding. In the event of an error in the recipient's contact details, or an incomplete address, the Artist cannot be held responsible for the impossibility of delivering the products ordered.

 

ARTICLE 3: PAYMENT

Payment for your purchases is made when ordering, in euros only:

  • either online: payments are accepted by Paypal® (payment cards + Paypal accounts) and by credit card (SSL secure protocol, supplier: Stripe).

  • or by check (for France only) made out to "David Bonnafous", and to be sent to David Bonnafous, 40 rue Prairial, 94500 Champigny sur Marne, taking care to include a copy of the order and your contact details .

  • or by bank transfer: send us a request at contact@victorian-animals.com, so that we can tell you what to do.

 

For orders of tailor-made portraits , the payment of a first deposit of 75 euros when ordering is required for the start of the work by the Artist (sketch costs). The balance, which will be invoiced upon validation of the proof (Bon à Tir), is payable for the launch of the printing of the portrait produced. Note that you can also adjust the entire portrait to order. The author cannot be held responsible for any delay in the execution of the work due to failure to comply with any of these regulations.

For orders for numbered prints of original works , payment in full is required when ordering, in order to launch the corresponding prints with our printing partners.

By these terms of payment, late penalties are not provided for. In application of the law 80-335 of May 12, 1980 the ordered articles will remain the property of David Bonnafous, alias John Byron, until full payment.

ARTICLE 4: ACHIEVEMENT & DEADLINES

Completion times are indicative and subject to possible variation (number of orders in progress, Customer responsiveness, external factors, etc.). The author cannot be held responsible for any delays caused by the Client (poor quality of the photographs transmitted, responsiveness of the Client, in particular delay in exchanges and payments, etc.), or by his suppliers or partners (delay due to the printer, delivery man). The Customer will be informed by email or telephone.

Allow on average 5 to 6 weeks for the realization of a tailor-made portrait, and 2 to 3 weeks for the delivery of a numbered print, 4 if you wish to entrust us with the framing. The deadlines will be specified to you upon receipt of your order. A delay cannot give rise to any compensation.

 

Regarding the realization of tailor-made portraits , the work begins as soon as your order is registered and your payment (sketches costs or all).

  1. We acknowledge receipt, validate that everything is in conformity and that all the elements necessary to better perceive your expectations and realize your portrait have been sent to us. We will contact you if necessary.

  2. We then begin the sketching work on the basis of the elements received, and keep you informed of the deadline for sending the sketches (count 8 to 15 days).

  3. We send you the sketches (in low definition) and validate all the elements of the portrait with you. No worries: the definition, the outlines as well as the overall rendering constitute a first draft of the portrait that will be produced. The final rendering will obviously be of much better quality.

  4. Upon receipt of your agreement on these elements, we will send you the invoice for the balance of your order. We will also validate with you if you wish a frame and wish to entrust us with the framing, in which case, we will add to the balance of the portrait, the order of the frame, including the framing and postage costs.

  5. Upon receipt of payment of the balance, we send the portrait for printing, and will keep you informed of the deadline for sending your portrait to your home (allow 2 to 3 weeks, or even 4 if framing is desired).

 

As for the numbered prints of original works , a delay of 2-3 weeks, or even 4 if you entrust us with the framing, is to be expected.

  1. We acknowledge receipt of your order, and confirm that everything is compliant. We will contact you if necessary.

  2. We send the portrait for printing, according to the dimensions chosen, or adapted to the precise dimensions of the frame if necessary (at no additional cost), to our printing partners.

  3. We confirm the dispatch of your order to your home, upon receipt of the prints.

ARTICLE 5: SHIPPING

The work will be shipped according to the format by Post, Mondial Relay, or any other specialized carrier, to the delivery address indicated when ordering. The Artist cannot be held responsible for any damage caused by transport. Participation in delivery costs, including insurance. All packages must be opened in the presence of the delivery person. It is your responsibility, in the event of breach or damage, to issue precise and detailed reservations to the carrier at the time of delivery, specifying the details of the damage on the delivery slip, in order to benefit from the insurance contracted. . If the driver refuses to stay for the opening of the package, the package must be refused.

If these procedures are not followed, you will not be able to benefit from any refund or resend.

ARTICLE 6: ORDER WITHDRAWAL / CANCELLATION

Artistic creations made to measure and at the request of the Customer are not eligible for the right of withdrawal (article L121-20 of the consumer code). The Customer cannot therefore benefit from any reimbursement on the tailor-made portraits after acceptance of the proof and payment for the entire order, nor on the numbered prints when you entrust us with the framing of these ( readjusted and non-standard dimensions to the exact dimensions of the frames), or whether these are of specific dimensions or on specific supports (special and made-to-measure orders).

Regarding the numbered prints offered in standard formats & supports and for sale on the site, you have a right of withdrawal of 10 calendar days to return us the work that would not be suitable, according to article L121-20 of the consumer code. This must be returned to us in perfect condition, in its original packaging, accompanied by a copy of the invoice and the certificate of authenticity. The return costs are your responsibility. We thank you in this case for contacting us within 2-3 days of receiving your order (email to contact@victorian-animals.com ), to inform us and so that we can give you the terms of return and / or exchange. Refunds will be made within a period of less than or equal to 15 days following receipt of the works by us. The refund will be made either by credit to your bank account or by check sent to the name of the Customer who placed the order. No cash on delivery will be accepted, whatever the reason.

ARTICLE 7: RIGHTS & PROPERTIES OF WORKS

All the elements of the site " www.victorian-animals.com ", whether they are texts, literary data, graphics, photographs, and works presented on the site are protected by copyright and property code. intellectual (CPI). Unless expressly authorized in writing, reproduction and any use of the works, other than individual and private consultation, are prohibited.

At the level of the works ordered, in accordance with the CPI (articles L.121-1 to L.121-9), only the economic rights explicitly stated in the conditions of transfer will be transferred to the Customer, to the exclusion of any other, and this within the limits appearing therein.

It is recalled that the moral right of a creation (also including the right to respect for the work and the right to respect for the name) remains attached to its author in a perpetual and imprescriptible manner. Any full or partial representation or reproduction made without the consent of the author or his successors in title is illegal, and punishable according to the laws relating to the offense of counterfeiting. It is the same for the translation, the adaptation or the transformation, the arrangement or the reproduction by any art or any process (Art. L. 122-4 of the CPI).

The totality of the production and the rights relating thereto, subject of this order, remains the entire and exclusive property of the author as long as the invoices issued are not paid in full by the Customer, up to the total amount of the order and any amendments concluded during the service. As a corollary, the Customer will become the de facto owner of the rights assigned from the final payment and settlement of all the invoices issued by the author as part of the order.

ARTICLE 9: ADVERTISING

The author reserves the right to mention his realization for the Client as a reference and to quote textual or iconographic extracts of the works concerned within the strict framework of his efforts of commercial prospecting, external communication and advertising. Any reservation to the author's publicity right must be notified and negotiated before the quote is signed and mentioned on the invoice.

ARTICLE 10: COMPETENT COURT & APPLICABLE LAW

Any question relating to these T & Cs is governed by French law.

Any dispute likely to arise between the Client and the Artist, and which cannot be resolved amicably, will fall under the exclusive jurisdiction of the courts of Paris.
